Threats to Inter-Religious and Inter-Civilization
\nHarmony resulting from actions taken by the Republic of Turkey around the
\nre-conversion of Museums -namely Hagia Sophia- to Mosques and <\/span><\/b>the use of
\ninflammatory rhetoric and propaganda conducive
\nto a hostile environment for living communities<\/o:p><\/span><\/span><\/b><\/p>\n

The Ecumenical Federation of Constantinopolitans (EFC)
\nis the worldwide federative body of the expatriated Greek-Orthodox Community of
\nIstanbul. Most of the population (98%) of our Community is, contrary to the
\nwishes of its members, presently living in various countries, away from their
\nnative land, Istanbul. This mass scale expatriation occurred as a result of the
\nnationalist and discriminatory policies drawn up and implemented by the
\nsuccessive Governments of the Republic of Turkey during the period 1955-2002.
\nThe veracity of the facts which led to this flight has been acknowledged, on
\nnumerous occasions, by the present leadership of Turkey[1]<\/span><\/sup><\/span><\/sup><\/a>.
\nDuring the past 10 years, EFC has submitted several proposals to the Government
\nof Turkey <\/span>stressing the clear need for <\/span> <\/span>implementation
\nof <\/span>effective and proportionate <\/span>remedy and reparations measures <\/span>in order<\/span> to prevent the
\nextinction of the Community still present  
\n<\/span>in Istanbul, along the lines of the U.N. General Assembly Resolution
\n60\/147[2]<\/span><\/sup><\/span><\/sup><\/a>.<\/o:p><\/span><\/p>\n

The members of the small Community still remaining in
\nIstanbul have suffered multiple serious human rights violations and abuses,
\nincluding of their minority rights,  <\/span>and
\ntheir further survival and existence depend on the predominance of a much
\nneeded atmosphere of tolerance and respect of religious and cultural
\ndifferences. <\/o:p><\/span><\/p>\n

Unfortunately, the recent conversion from museum to
\nmosque of the Byzantine era (6th<\/sup> Century A.D.) built Hagia Sophia
\nChurch<\/span>, a site inscribed on UNESCO\u2019s World Heritage List, <\/span>has been superseded by hostile slogans <\/span>conducive to <\/span>creating
\ntensions between religions and civilizations. <\/span>This inflammatory rhetoric was e<\/span>spou<\/span>sed, among
\nothers, by Turkish public officials<\/span>.  <\/span>The widespread use of claims of the \u201cright of
\nsword and conquering\u201d which was openly expressed – in the presence of the
\nPresident of the Republic of Turkey – 
\n<\/span>during the ceremonial conversion of Hagia Sophia by the President of
\nReligious Affairs of Turkey Mr. Ali Erba<\/span>\u015f, <\/span>who delivered his inaugural speech keeping in his hand
\na sword, was very unbecoming.  <\/span>The
\nPresident of the Nationalist Movement Party Mr. Devlet Bahceli, which supports
\nthe current Government of Turkey, openly claimed the \u201cnecessity of eliminating
\nthe remaining Byzantines\u201d.  <\/span>Furthermore,
\naccording to press information verified by a question submitted by the leading
\nopposition party (CHP), a flag of Taliban organization was seen during the
\nabove-mentioned inaugural ceremony[3]<\/span><\/sup><\/span><\/sup><\/a><\/o:p><\/span><\/p>\n

It is clear that <\/span>the prevalence of <\/span>such attitudes, reminding our Community of the era of
\npersecutions it went through during the period 1955-2002, is highly alarming
\nand runs contrary to the much needed \u2013on a global scale- inter-religious and
\ninter-civilizational mutual respect. This is especially true in a region has
\nsuffered a series of human tragedies, often caused by those exploiting and
\ninstrumentalizing religion as well as cultural heritage for their own political
\nagendas. Furthermore, hate speech against Christianity was also used by a part
\nof media inside Turkey, in view of the conversion of Hagia Sophia to a mosque[4]<\/span><\/sup><\/span><\/sup><\/a>.
\n<\/o:p><\/span><\/p>\n

The Republic of Turkey is called to take all necessary
\nmeasures <\/span>to prevent such acts<\/span> and<\/span> refrain from
\nany action<\/span> or statement spurring
\ninter-religious tensions <\/span>and therefore<\/span> <\/span>endanger<\/span>ing<\/span> the living
\nconditions and even the very<\/span> existence of
\nnon-Muslim minorities. <\/o:p><\/span><\/p>\n

The
\nNecessity of Scientific Conservation and Management of the World Heritage
\nMonument of Hagia Sophia of Istanbul and other cultural heritage sites in
\nTurkey for the respect, promotion and protection of the cultural rights of all.<\/span><\/b><\/p>\n

World cultural
\nheritage monuments constitute some of humanity’s major achievements. They stand
\nas irreplaceable masterpieces of humanity’s varied civilizations and cultures
\nboth past and present. As such, they need to be protected and treasured; their
\nvalue should be brought out and shared with the world – not hidden away.  <\/span><\/o:p><\/span><\/p>\n

This ideal is embodied in the 
\n<\/span>1972 UNESCO Convention \u201cConcerning the Protection of World Cultural and
\nNatural Heritage\u201d, by which states undertake the duty, among others, of
\n“ensuring the identification, protection, conservation, presentation and
\ntransmission to future generations\u201d of monuments recognized as constituting part
\nof the World Heritage\u201d. Chief among the concerns mentioned in this document is
\nthe preservation of monuments\u2019 authenticity. States therefore have an
\nobligation to ensure that any modification to the monuments does not negatively
\nimpact the Outstanding Universal Value of inscribed sites on their territories
\nincluding their integrity and\/or authenticity. Therefore, any major change in
\nthe use of a World Heritage Monument, including its restoration, should be
\nsubmitted to the World Heritage Committee of UNESCO for prior consideration and
\ncomments before any action is taken.<\/span><\/p>\n

From a Human Rights standpoint, the importance of Cultural
\nHeritage has been established on numerous occasions.  <\/span>The right of access to and enjoyment of
\ncultural heritage has been recognized as part of international human rights
\nlaw, finding its legal basis in the right for all to take part in cultural life
\nwithout discrimination. In this vein, Special Procedures of the Human Rights
\nCouncil have stressed that access to and enjoyment of cultural heritage are
\ninterdependent concepts \u2013 one implying the other. They convey an ability to,
\ninter alia, know, understand, enter, visit, make use of, maintain, exchange and
\ndevelop cultural heritage, as well as to benefit from the cultural heritage and
\ncreations of others, without political, religious, economic or physical
\nencumbrances[5]<\/span><\/sup><\/span><\/sup><\/a>.
\nTherefore, States should respect the free development of cultural heritage,
\nhaving the duty not to destroy, damage or alter cultural heritage, at least not
\nwithout the free, prior and informed consent of concerned communities[6]<\/span><\/sup><\/span><\/sup><\/a>. <\/o:p><\/span><\/p>\n

Contrary to the above mentioned International Law, monuments
\nnamed Hagia Sophia, originally built during the Byzantine era as Orthodox
\nChurches and having operated for more than 50 years as museums, have been
\nre-converted over the past years to mosques in the Republic of Turkey. This
\nre-conversion does not seem to serve any religious or functional need, as all
\nof them operate in areas where the numerous, and often historical, mosques already
\ncover the needs of believers. On the contrary, justifications raised for this
\nprocess of conversions were largely of a political nature, aimed chiefly at the
\nsecularist establishment of the Republic of Turkey. <\/o:p><\/span><\/p>\n

This conversion process started with the 6th<\/sup>
\nCentury Hagia Sophia of Iznik (Nicaea), where the first and seventh Ecumenical
\nCouncils of the Christian Church took place (1st<\/sup> and 7th<\/sup>).
\nIt continued with the13th<\/sup> Century Trabzon Hagia Sophia, while two
\nsmaller \u201cHagia Sophia\u201d in Eastern Thrace were also re-converted. Finally, the
\nuniversally famous World Heritage Monument that is Hagia Sophia of Istanbul,
\nwas re-converted to a mosque by a Presidential Decree which followed a ruling
\nof Turkish Council of State, founding its argumentation on Ottoman-era legislation.
\nNumerous legal experts have stated the weak legal grounds on which this Court
\ndecision was taken, as the Presidential Decree establishing the Hagia Sophia of
\nIstanbul as a museum had been in force for 86 years. Furthermore, all requests
\nto overturn this 1934 presidential decree had consistently been dismissed in
\nprevious years.<\/o:p><\/span><\/p>\n

By converting Museums into Mosques, the Republic of Turkey
\nmoves towards stripping these monuments of Universal Value of their Universal
\ncharacter. It chooses to exclude when the decision to turn them into museums
\nwas a move to include all humanity; It chooses to hide when the previous
\ndecision was to reveal. As stressed by human rights experts, these actions
\ndivide religious and cultural groups in Turkey and beyond, rather than uniting
\nthem.[7]<\/span><\/sup><\/span><\/sup><\/a><\/o:p><\/span><\/p>\n

The worrisome character of this conversion process is further
\nhighlighted by the fact that it is related to political debates on historical
\nevents that took place inside Turkey during the establishment of the secular
\nregime in 1920-30\u2019s. Furthermore, inflammatory statements regarding a so-called
\ncompletion of the re-conquest of Istanbul, for the second time since 1453, are
\nalarming, as they raise tensions in a world in dire need of reconciliation
\nbetween world religions and civilizations. <\/o:p><\/span><\/p>\n

As the worldwide federative body of the autochthonous
\nGreek-Orthodox (Rum) minority  <\/span>of
\nIstanbul, the Ecumenical Federation of Constantinopolitans wants to raise  <\/span>the issue of the high necessity of the
\nprotection of the above-mentioned monuments as part of the worldwide cultural
\nheritage, protecting them from the dangers to which their instrumentalization
\nfor political gains exposes them. <\/o:p><\/span><\/p>\n

As a historic Christian community of Istanbul, we share
\nspecial procedures mandate holders grave concern regarding about the rights of
\neveryone to access and enjoy these monuments of cultural heritage, about
\ninter-faith co-existence and secular spaces, and about the equality and safety
\nof religious minorities, including Christians[8]<\/span><\/sup><\/span><\/sup><\/a>.<\/o:p><\/span><\/p>\n

Moreover, we are convinced that monuments of such importance
\nshould be administered in a way ensuring that science and culture take
\nprecedence on political games. Their maintenance should be under the care of
\nscientists and scholars of proven expertise, duly authorized through administrative
\nprocesses guaranteeing the protection of cultural heritage under international
\nlaw.<\/o:p><\/span><\/p>\n

We call upon the Authorities of the Republic of Turkey o:<\/o:p><\/span><\/p>\n

–       
\n<\/span><\/span><\/span>Stop the conversion of museums of monuments built in
\nByzantine era such as the Church of the Holy Saviour of Chora (Kariye-Hora
\nMuseum), itself a World Heritage site, which incorporates unique 14th century
\nmosaics and frescoes of unique value.<\/o:p><\/span><\/p>\n

 <\/o:p><\/span><\/p>\n

\n<\/span><\/span><\/span>Immediately cooperate with UNESCO
\non the protection of the above-mentioned monuments and especially of the Hagia
\nSophia of Istanbul.<\/o:p><\/span><\/span><\/p>\n

\n<\/span><\/span><\/span>Take all necessary legal and administrative
\nmeasures to ensure that maintenance specialists participate in the
\nadministration of the above-mentioned monuments and that the right of access to
\nand enjoyment of cultural heritage is fully respected for all, without any
\ndiscrimination whatsoever. <\/o:p><\/span><\/p>\n

\nnecessity for the Republic of Turkey to actively support the Repatriation of
\nthe younger generation, descendants of the Greek-Orthodox Minority of Istanbul
\nas the only measure to prevent the disappearance of this Autochthonous
\nCommunity<\/span><\/b><\/p>\n

–       
\n<\/span><\/span><\/span>The severe violations of the human rights of the
\nGreek-Orthodox Minority during the years 1923-2003 has caused this Community to
\nbe living today as an expatriate community to 
\n<\/span>the extent of  <\/span>98% of its
\npopulation.  <\/span>The fundamental reasons of
\nthis mass scale expatriation has been the 65 years ago mass scale Pogrom of 6-7
\nSeptember 1955 and the systematic deportations during the period 1964-66 while
\nthe discriminatory measures continued for decades. We have stated in detail
\nduring the last 8 years in numerous U.N. Conferences these violations of the
\npast. Presently the Minority living in Istanbul are less than 1500 persons,
\nmost of them being of advanced age, and is facing the specter of complete
\nannihilation.<\/span><\/p>\n

–       
\n<\/span><\/span><\/span>The only measure to prevent the disappearance of this
\nhistoric Community is Turkey to actively support the proposals submitted by the
\nEFC focusing on the repatriation of young people whose parents are descendants
\nfrom Istanbul and in parallel to reinstitute all the rights of the Minority.
\nThe proposals of EFC include provision of scholarships for the young people to
\nstudy in Universities, support for housing and establishing SME\u2019s, employment
\nin state agencies and various incentives for repatriation. The role of the
\nMinority welfare foundations in this effort is essential.   <\/span>The prevention of elections during the last
\n8 years in the non-Muslim minority foundations has severely damaged their
\nproper function in fulfilling their important role.<\/span><\/p>\n

\n<\/span><\/span><\/span>The proposals submitted by EFC are aligned with the
\nResolution of the United Nations General Assembly Resolution 60\/147. <\/span><\/p>\n

\n<\/span><\/span><\/span>Furthermore, we
\nwould like to state the fact the European Commission has rejected all proposals
\nof EFC during the last 6 years, to support the repatriation of the young
\nmembers of the Community.<\/span><\/b><\/p>\n

\n<\/span><\/span><\/span>EFC stresses the urgent necessity of proposed measures
\nfor the survival of the Greek-Orthodox Community of Istanbul in the context of
\nhuman rights framework.<\/span><\/p>\n
