You are mistaken if you think that the expert group is a State entity. The group composed of scholars of religion who have relevant competences, academic titles and scientific degrees, and appropriate scientific contribution on the subject of examination. Such scholars normally are invited by the State body on religious affairs to analyze a particular issue, institution or phenomenon. The state body of religious affairs regularly provides for a significant number of examinations, each time involving experts in a particular domain of religious studies. Usually, they are not governmental officials and civil servants. Naturally, the State Service of Ukraine for Ethnic Affairs and Freedom of Conscience takes into account the conclusions reached by the experts and relies on their knowledge and competences.<\/p>\n\n\n\n
You do not question the need for an expert examination and rightly note that “t<\/em>here are obviously doubts about the status of the UOC which can be understood in the context of the war Russia launched against Ukraine<\/em>“. Since the beginning of the war, which Russia unleashed back in February 2014, the UOC has given ample grounds for such doubts. Both regarding its status and its civil position. Moreover, a very specific pacifism, in which appeals to end the war were addressed exclusively to Kyiv, not Moscow, calls to disrupt the process of military mobilization, refusal to honour Ukrainian soldiers while almost simultaneously legitimising guerrilla gang`s parades, the consecration of Russian weapons of mass destruction, and so on – all this and much more was not the handywork of a handful of collaborators, but of the Church hierarchy, the top officials of the UOC.<\/p>\n\n\n\n The Council of the UOC on May 27, 2022 which removed all references to the Russian Church and the Moscow Patriarchate from the Church’s Statute, was welcomed by society and observers. Including, among others, some of the experts who prepared the examination we are currently discussing. But the enthusiasm faded rather quickly. The behaviour of the hierarchy remained unchanged; some of its representatives directly stated that the changes adopted by the Council “do not change anything<\/em>“, the Orthodox Church of Ukraine (OCU) continued to be proclaimed the main enemy of the UOC, and the very Ukrainian authorities were to blame for the Russian invasion (although, as the members of the Synod of the UOC sensibly stressed, the previous<\/em> Ukrainian government). In other words, doubts concerning of the status of the UOC seemed quite clear. And such doubts were raised not only by broad sections of the public and the state officials but also within the Church. You certainly know that growing number of the UOC\u2019s priests have been asked the leadership about the status of their Church and urged hierarchies to break ties with Moscow.<\/p>\n\n\n\n Therefore, returning to the methodology<\/em><\/strong>, the experts do not deny the right of the UOC to exist “\u2026 according to previously unknown rules and procedures, whatever they might mean in theological terms<\/em>“. They, as well as the faithful and clergy of the UOC, are interested in whether these frameworks and procedures keep this Church within the Russian Orthodox Church or whether the former has ceased to be part of the latter.<\/p>\n\n\n\n And here is another methodological<\/em><\/strong> problem on which I have to express disagreement with you. You wrote that “… the Commission is not a body entitled to apply canon law \u2026”, “\u2026 it is not the task of the REC to judge whether that is in accordance with canon law, and to draw any consequences from that<\/em>“. But religious studies, as a scientific discipline that study, among other issues, religious institutions, simply cannot help but refer in its analysis of the status of a particular ecclesial unit to the norms according to which this unit functions in the Church’s plentitude, that is, to the canon law. The secular state is not guided by these norms, but it would be problematic to describe the nature of the relationship that exists between two religious institutions without recourse to the internal guidelines of these institutions.<\/p>\n\n\n\n As for the assessment of the facts<\/em><\/strong> by the expert group, you consider it biased on the basis that the experts cite a letter in which Ecumenical Patriarch Bartholomew assesses the status of Metropolitan Onufriy not as the canonical Metropolitan of Kyiv, but as a hierarch of the Russian Church based in Ukrainian capital. However, the experts do not draw any other conclusion from this than that the Ecumenical Patriarch recognises the UOC as part of the Russian Orthodox Church, whose jurisdiction over Ukraine Constantinople does not recognise. The expert group could have been accused of bias, incompetence etc. for not presenting an alternative point of view. At the same time the experts honestly noted that they could not find documents, statements, or judgements of the Primates of other Local Orthodox Churches that would disagree with the position of Patriarch Bartholomew on this particular issue and recognise the UOC as an independent Church. Such documents and statements are unknown to me and, judging by your analysis of the Conclusion, to you as well.<\/p>\n\n\n\n As for the “… there is no consensus in world Orthodoxy about how to gain autocephaly<\/em>“, which you wrote about, it is hard to disagree with this. But this is very distantly related to the issue we are discussing. After all, the UOC did not proclaim autocephaly unilaterally (as has happened many times in Church history), nor did it receive such status from the Ecumenical Patriarchate (as most Local Churches did), nor did it receive it from a Kyriarchal church (such as the Orthodox Church of America).<\/p>\n\n\n\n Now let’s move on to the actions<\/em><\/strong> that, in your opinion, the experts underestimated. You admit that they did not ignore the decision of the Council of May 27, 2022 on the issue of holy chrism producing and the decision to open parishes abroad, but they do not consider this as a sign of an independent church. I have to agree with them. The privilege of producing chrism was recognised for the Metropolitan of Kyiv in pre-Moscow times and was confirmed by the Local Council of the Russian Church in 1917-1918. This privilege does not point to independence buti rather to the honorary status of the Metropolitan of Kyiv which was historically recognised within the Russian Church in one way or another. I also have to agree with the experts about the opening of parishes abroad. This in no way underscores the independence of the UOC. In some places such an opening takes place with the support of the Russian Church and does not raise any objections from the Moscow Patriarchate which understands that Ukrainians refugees fleeing from Russian invasion in Europe may simply throw the Russian \u2018spiritual professionals\u2019 out of the church\u2019s building.<\/p>\n\n\n\n If we continue to talk about actions<\/em><\/strong>, then in 2023, that is, after the signing of the Conclusion, the UOC did not do much to refute the results of examinations. Take, for example, the re-subordination of the dioceses of Crimea and Donbas directly to Moscow. This is what the leadership of a structure usually has the right to do in relation to its components. And if the hierarchy of the UOC believes otherwise, it had every opportunity to proclaim different stance. But it did not do so, to the deep disappointment of its clergy and faithful.<\/p>\n\n\n\n Now for the documents<\/em><\/strong> that could shed light on the issue of dependence\/independence of the UOC from the ROC. And here it is difficult for me to agree with your comments about the irrelevance in this case of documents “… written when the UOC did not claim to be independent from the ROC<\/em>“. Firstly, the UOC claimed its independence long before the local council of May 27, 2022. On this basis, in particular, the church leadership refused and continues to refuse to comply with Law No. 2662-VIII (2018) on changing the name of religious organisations whose governing centre is located in the aggressor country. Secondly, the experts simply could not ignore the “Letter of Alexy II, by the grace of God, Patriarch of Moscow and All Russia to Metropolitan Filaret of Kyiv and All Ukraine” of October 27, 1990. After all, the current Statute on the Governance of the Ukrainian Orthodox Church directly refers to it.<\/p>\n\n\n\n At the same time, perhaps the most serious objection you have is the Expert Group’s consideration of the status given to the UOC by the documents of the Russian Church.<\/em><\/strong> You rightly argue that “… no ROC document can prove anything in connection with the UOC …<\/em>” and that “\u2026 to rely on any documents, statutes, and other sources from Russia and from the ROC is highly problematic, as this way a Russian organization can influence Ukrainian political and administrative decisions<\/em>“. This is true, but if, for example, the bishops of the UOC do not consider themselves members of the ROC\u2019s bishops corps, and the latter insists on the opposite, why don’t the bishops of the UOC declare that they are not part of the Russian Church’s episcopate? Why don’t they consider it normal that an organisation to which they do not belong officially lists them as its functionaries? Every comparison is limitig but let me give you a simple instance that we both do understand. For a long time, both you and I were members of the International Scientific Council of the quite reputable academic religious studies journal that has been published in Moscow. After the outbreak of the war unleashed by Russia against Ukraine, both you and I informed the editorial board that we recall our names from the above-mentioned Council. At this point, it is not about beliefs, morality or civic position but about the logic of actions. Essentially, if an organization claims that you are a part of it, but you don\u2019t want to be associated with it, you should clearly tell the organization and possibly others whose views matter to you that you are not affiliated with it. The bishops of the UOC have never addressed the ROC with letters of exclusion from the episcopate, the Synod, the Inter-Council Presence, Synodal commissions, etc. Despite the calls of the outraged public and the pleas of their own clergy, they have done nothing to prevent their names from being associated with real war criminals who sanctify missiles that kill children and openly call for the burning down of Ukrainians with a heavy flamethrower Solntsepyok<\/em> (Sunburns).<\/p>\n\n\n\n In your analysis you do not exclude that the Conclusion of the religious examination was made in violation of Ukrainian law. However, you do not cite any provisions of the Ukrainian legislation that were violated. In fact, the Examination was appointed in full compliance with the Law of Ukraine “On Freedom of Conscience and Religious Organisations” as well as the Regulation on the State Service of Ukraine for Ethnic Affairs and Freedom of Conscience. Both the Law and the Regulation require the involvement of representatives of religious organisations in the Examination. Accordingly, the State Service of Ukraine for Ethnic Affairs and Freedom of Conscience invited a representative of the UOC to the joint work. However, the representative of the UOC not only refused to participate but declined to provide written explanations or any documents related to the case. Moreover, after this demarche, I addressed Metropolitan Onufriy in writing to delegate his representative to work on the Opinion and\/or provide the necessary documents, explanations, judgements, comments, observations, remarks that Metropolitan Onufriy would consider necessary. But His Beatitude refused to do so.<\/p>\n\n\n\n I would like to draw your attention to the fact that the expert group unanimously supported the Conclusion. This document was supported by both those members of the expert group whose recusal was demanded by the UOC and those to whom no complaints were made.<\/p>\n\n\n\n Please note that the Conclusion provoked a strong reaction and lively discussion in the church and public environment, and this discussion included everything from long excursions into church history to heated debates over the particularities of canon law and personalities of experts. But no one has been able to prove that the UOC is not a part of the Russian Church. In fact, you do not assume responsibility for asserting this either. The expert group, after all, cannot impose anything on the leadership of the UOC. Hierarchs know what they need to do in order to stop being part of the Moscow Patriarchate; what messages they need to send to society to overcome the suspicion and doubts that have accumulated over the decades. And this is being said to them not only by the officials and civil society activists, but also by a growing number of their own clergy and laity. Unfortunately, the hierarchy does not heed their calls. Some of the hierarchs prefer to act on the principle \u2018the worse the better\u2019 and deliberately intensify confrontation with the authorities and civil society. The hierarchy stubbornly refuses to engage in dialogue with civil society, authorities, and even their own clergy and faithful, who are trying to reach out to them. They don’t even feel the need to explain why they are pushing the Ukrainian Orthodox Church down a path dictated by the Kremlin. However, this is a problem that I would be more than willing to discuss with you, but it falls outside the scope of our current discussion about the Expertise Conclusions. Il ne s\u2019agit pas non plus du lien mystique, de cette unit\u00e9 dans les dogmes et la communication eucharistique qui lie toutes les \u00c9glises locales au sein de l\u2019\u00c9glise unique, sainte, cath\u00e9drale, apostolique, mais exclusivement du lien canonique. C\u2019est-\u00e0-dire une relation bas\u00e9e sur les normes et les r\u00e8gles du syst\u00e8me eccl\u00e9sial.<\/p>\n\n\n\n Vous vous trompez lorsque vous pensez que le groupe d\u2019experts est un organisme \u00e9tatique. Il s\u2019agit de chercheurs en religion qui poss\u00e8dent des comp\u00e9tences appropri\u00e9es, des titres acad\u00e9miques et des travaux scientifiques pertinents en mati\u00e8re d\u2019expertise ; et qui sont invit\u00e9s par l\u2019organisme public en mati\u00e8re de religion \u00e0 analyser un probl\u00e8me, une institution ou un ph\u00e9nom\u00e8ne particulier. L\u2019organisme public charg\u00e9 des affaires religieuses a assur\u00e9 la r\u00e9alisation d\u2019un nombre important d\u2019examens, impliquant chaque fois dans l\u2019analyse des experts-sp\u00e9cialistes dans l\u2019un ou l\u2019autre domaine des \u00e9tudes religieuses, qui ne sont g\u00e9n\u00e9ralement pas des fonctionnaires. Bien entendu, dans ses activit\u00e9s, le Service national de l\u2019ethnopolitique et de la libert\u00e9 de conscience tient compte des conclusions de ces sp\u00e9cialistes. <\/p>\n\n\n\n Vous ne remettez pas en question la n\u00e9cessit\u00e9 d\u2019un examen et notez \u00e0 juste titre que \u00ab \u2026 dans le contexte de la guerre d\u00e9clench\u00e9e par la Russie contre l\u2019Ukraine, des doutes sont apparus quant au statut de l\u2019UOC, et cela est tout \u00e0 fait compr\u00e9hensibl<\/em>e \u00bb. Depuis le d\u00e9but de la guerre d\u00e9clench\u00e9e par la Russie en f\u00e9vrier 2014, l\u2019\u00c9glise orthodoxe ukrainienne a suffisamment fond\u00e9 ses doutes par rapport \u00e0 son statut et \u00e0 sa position. Par ailleurs, un pacifisme tr\u00e8s particulier, o\u00f9 les appels \u00e0 la fin de la guerre s\u2019adressaient exclusivement \u00e0 Kiev et non \u00e0 Moscou, les appels \u00e0 perturber la mobilisation, le refus d\u2019honorer les soldats ukrainiens pour la l\u00e9gitimation quasi simultan\u00e9e des d\u00e9fil\u00e9s militants, la cons\u00e9cration des armes de destruction massive russes , etc. \u2013 tout cela n\u2019\u00e9tait pas du tout le cas d\u2019une poign\u00e9e de collaborateurs, de la hi\u00e9rarchie eccl\u00e9siale et du clerg\u00e9 de l\u2019EOU PM.<\/p>\n\n\n\n Le Concile de l\u2019EOU (Mgr Onuphre) du 27 mai 2022<\/strong><\/a> , au cours duquel toutes les r\u00e9f\u00e9rences \u00e0 l\u2019\u00c9glise russe et au Patriarcat de Moscou ont \u00e9t\u00e9 supprim\u00e9es du Statut de l\u2019\u00c9glise, a \u00e9t\u00e9 accueilli tr\u00e8s favorablement par la soci\u00e9t\u00e9 et de nombreux observateurs. Y compris, soit dit en passant, certains sp\u00e9cialistes qui ont pr\u00e9par\u00e9 l\u2019expertise en question . Mais assez vite, l\u2019enthousiasme s\u2019est estomp\u00e9. Le comportement de la hi\u00e9rarchie est rest\u00e9 inchang\u00e9 ; certains de ses repr\u00e9sentants ont directement d\u00e9clar\u00e9 que les changements adopt\u00e9s par le Conseil \u00ab ne modifient rien \u00bb, que les principaux ennemis de l\u2019EOU (Mrg Onuphre) restaient l\u2019EOU (Mgr Epiphane) et que le gouvernement ukrainien \u00e9tait responsable de l\u2019invasion russe (bien que, comme le disent les membres du Synode l\u2019EOU avait judicieusement soulign\u00e9 \u00e0 l\u2019\u00e9poque \u2013 c\u2019\u00e9tait le pr\u00e9c\u00e9dent gouvernement ukrainien). Autrement dit, la question du statut de l\u2019\u00c9glise orthodoxe ukrainienne semblait tout \u00e0 fait l\u00e9gitime. Les pr\u00eatres de l\u2019\u00c9glise orthodoxe ukrainienne ont pos\u00e9 et continuent de poser publiquement des questions aux dirigeants sur le statut de leur \u00c9glise, ils appellent \u00e0 la rupture de ses liens avec Moscou.<\/p>\n\n\n\n Par cons\u00e9quent, revenant \u00e0 la m\u00e9thodologie, les experts ne nient pas le droit de l\u2019\u00c9glise orthodoxe ukrainienne d\u2019exister dans le cadre \u00bb ... des r\u00e8gles qui n\u2019\u00e9taient pas appliqu\u00e9es auparavant et des proc\u00e9dures, quelles qu\u2019elles soient d\u2019un point de vue th\u00e9ologique. \u00bb <\/em>Eux, ainsi que les fid\u00e8les et le clerg\u00e9 de l\u2019EOU (Mrg Onuphre) , voudraient savoir si ces bases et ces proc\u00e9dures laissent cette \u00c9glise en tant partie de l\u2019\u00c9glise orthodoxe russe, ou si la premi\u00e8re a cess\u00e9 de faire partie de la seconde.<\/p>\n\n\n\n Et voici un autre probl\u00e8me m\u00e9thodologique sur lequel je suis oblig\u00e9 d\u2019\u00eatre en d\u00e9saccord avec vous.<\/strong><\/p>\n\n\n\n Vous \u00e9crivez que \u00ab \u2026 l\u2019examen religieux pour une institution publique ne peut pas \u00eatre fond\u00e9 sur le droit canonique<\/em>\u00ab . Mais les \u00e9tudes religieuses, en tant que discipline scientifique qui \u00e9tudie, entre autres, les institutions religieuses, ne peuvent tout simplement pas s\u2019emp\u00eacher de se tourner dans leur analyse du statut de telle ou telle unit\u00e9 eccl\u00e9siale vers les normes selon lesquelles cette unit\u00e9 fonctionne dans l\u2019int\u00e9grit\u00e9 de l\u2019\u00c9glise, c\u2019est-\u00e0-dire , au droit canonique. Un \u00c9tat la\u00efc n\u2019est pas guid\u00e9 par ces normes, mais, reconnaissons-le, il serait probl\u00e9matique de d\u00e9crire la nature de la relation qui existe entre deux institutions religieuses sans les directives internes de ces institutions.<\/p>\n\n\n\n Quant \u00e0 l\u2019\u00e9valuation des faits par le groupe d\u2019experts, vous la consid\u00e9rez comme biais\u00e9e du fait que les experts citent une lettre dans laquelle le patriarche \u0153cum\u00e9nique Bartholom\u00e9e \u00e9value le statut du m\u00e9tropolite Onuphre non pas en tant que m\u00e9tropolite canonique de Kiev, mais en tant que m\u00e9tropolite de l\u2019\u00c9glise russe PM dans la capitale ukrainienne. Mais les experts n\u2019en tirent aucune autre conclusion, si ce n\u2019est que le patriarche \u0153cum\u00e9nique reconna\u00eet l\u2019EOU comme faisant partie de l\u2019\u00c9glise orthodoxe russe, dont Constantinople ne reconna\u00eet pas la juridiction sur l\u2019Ukraine. Le panel pourrait \u00eatre accus\u00e9 de partialit\u00e9, d\u2019incomp\u00e9tence, etc. pour ne pas avoir pr\u00e9sent\u00e9 un point de vue alternatif. Cependant, les experts ont honn\u00eatement not\u00e9 qu\u2019ils n\u2019avaient pas pu trouver de documents, de d\u00e9clarations, de jugements de responsables d\u2019autres \u00c9glises orthodoxes locales qui seraient en d\u00e9saccord avec la position du patriarche Bartholom\u00e9e sur cette question particuli\u00e8re et qui reconna\u00eetrait l\u2019EOU en tant qu\u2019\u00c9glise ind\u00e9pendante. De tels documents et d\u00e9clarations me sont \u00e9galement inconnus et, \u00e0 en juger par votre analyse de la \u00ab Conclusion<\/em> \u00bb par vous aussi. <\/p>\n\n\n\n Quant \u00e0 \u00ab l\u2019absence d\u2019une opinion unique dans l\u2019Orthodoxie mondiale concernant l\u2019obtention de l\u2019autoc\u00e9phalie \u00bb, dont vous parlez, il est difficile de ne pas \u00eatre d\u2019accord avec cela. Mais cela a un rapport tr\u00e8s indirect avec le sujet dont nous discutons. Apr\u00e8s tout, l\u2019EOU (Mgr Onuphre) n\u2019a pas d\u00e9clar\u00e9 unilat\u00e9ralement l\u2019autoc\u00e9phalie (comme cela s\u2019est produit \u00e0 plusieurs reprises dans l\u2019histoire de l\u2019\u00c9glise), ni ne l\u2019a re\u00e7ue du Patriarcat \u0153cum\u00e9nique (comme la plupart des \u00c9glises locales).<\/p>\n\n\n\n Passons maintenant \u00e0 des actions qui, selon vous, ont \u00e9t\u00e9 sous-estim\u00e9es par les experts.<\/strong><\/p>\n\n\n\n Vous admettez qu\u2019ils n\u2019ont pas contourn\u00e9 la d\u00e9cision du Concile du 27 mai 2022<\/a> concernant la r\u00e9conciliation et la d\u00e9cision d\u2019ouvrir des paroisses \u00e0 l\u2019\u00e9tranger, mais ne consid\u00e9rez pas cela comme le signe d\u2019une \u00c9glise ind\u00e9pendante. Je dois \u00eatre d\u2019accord avec eux. Le privil\u00e8ge de primaut\u00e9 a \u00e9t\u00e9 reconnu par le m\u00e9tropolite de Kiev avant Moscou et confirm\u00e9 par le Conseil local de l\u2019\u00c9glise russe en 1917-1918. En fait, l\u2019expertise a \u00e9t\u00e9 d\u00e9sign\u00e9e en pleine conformit\u00e9 avec la loi ukrainienne \u00ab sur la libert\u00e9 de conscience et les organisations religieuses \u00bb, ainsi qu\u2019avec le statut du service public de l\u2019Ukraine pour l\u2019ethnopolitique et la libert\u00e9 de conscience. Cette discussion comportait de tout : de longues incursions dans l\u2019histoire de l\u2019\u00c9glise, des discussions passionn\u00e9es sur les particularit\u00e9s du droit canon et des discussions sur les qualit\u00e9s personnelles des membres du groupe d\u2019experts. Mais aucun des d\u00e9batteurs n\u2019a pu prouver de mani\u00e8re convaincante que l\u2019EOU ne fait pas partie de l\u2019\u00c9glise russe PM. En fait, vous n\u2019assumez pas non plus la responsabilit\u00e9 d\u2019affirmer une telle chose. <\/p>\n\n\n\n Apr\u00e8s tout, le groupe d\u2019experts ne peut rien imposer \u00e0 la direction de l\u2019EOU. Il sait exactement ce qu\u2019il faut faire pour cesser de faire partie du Patriarcat de Moscou ; quel genre de signaux doit-il envoyer \u00e0 la soci\u00e9t\u00e9 pour surmonter les soup\u00e7ons et les doutes accumul\u00e9s au fil des ann\u00e9es. Et ce n\u2019est pas seulement l\u2019\u00c9tat et la soci\u00e9t\u00e9 qui en parlent, mais aussi un nombre croissant de membres de leur propre clerg\u00e9 et de la\u00efcs. Malheureusement, leurs appels ne sont pas entendus par le clerg\u00e9. Certains hi\u00e9rarques pr\u00e9f\u00e8rent agir selon le principe \u00ab le pire est le mieux \u00bb et intensifient d\u00e9lib\u00e9r\u00e9ment la confrontation avec l\u2019\u00c9tat et la soci\u00e9t\u00e9.<\/p>\n\n\n\n La hi\u00e9rarchie refuse obstin\u00e9ment d\u2019engager un dialogue avec la soci\u00e9t\u00e9 civile, les autorit\u00e9s, voire ses propres religieux et fid\u00e8les qui tentent de les atteindre.
